Important: These Terms of Service govern use of the Cool Electric website and online services. They are intended as a general California-focused website terms document and are not a substitute for project-specific contracts, proposals, warranties, notices, or disclosures required for electrical, solar, battery, generator, or other contracting work.
1. Acceptance of Terms
By accessing or using CoolElectric.net (the "Website"), submitting a contact or estimate request, communicating with Cool Electric through the Website, or otherwise using online features provided by Cool Electric ("Cool Electric," "we," "us," or "our"), you agree to these Terms of Service. If you do not agree, do not use the Website. These Terms apply to Website use only unless a separate written agreement expressly incorporates them.
2. Company and Services
Cool Electric is a California electrical contracting business. Information on the Website may describe electrical, solar, energy storage, generator, EV charging, troubleshooting, repair, installation, and related services. Website content is general information and does not constitute a binding estimate, engineering determination, code-compliance determination, guarantee of availability, or agreement to perform work.
3. Estimates, Proposals, and Contracting Work
Requests submitted through the Website are requests for information or service and do not create a contractor-customer relationship by themselves. Pricing, scope, scheduling, equipment, permits, utility requirements, payment terms, warranties, change orders, cancellation rights, and other project terms will be governed by the applicable written estimate, proposal, home-improvement contract, service agreement, or other project document. If these Terms conflict with a signed project agreement, the signed project agreement controls for that project.
4. California Contractor Disclosures
Nothing in these Terms is intended to replace any notice, disclosure, contract language, cancellation notice, license information, mechanics-lien notice, or other requirement imposed by California law on a particular construction or home-improvement transaction. Required project-specific disclosures will be provided when applicable through the relevant contract or transaction documents.
5. Website Information and No Professional Reliance
We try to keep Website information accurate and current, but electrical codes, utility requirements, incentives, rebates, tax rules, manufacturer specifications, pricing, product availability, and permitting requirements can change. Website content should not be relied upon as electrical, engineering, legal, tax, financial, or safety advice. Site-specific electrical work should be evaluated by qualified professionals and performed in accordance with applicable requirements.
6. User Submissions
When you submit information through the Website, you represent that the information is accurate to the best of your knowledge and that you have authority to provide it. You agree not to submit unlawful, fraudulent, defamatory, malicious, or infringing content, or content designed to interfere with the Website or its security. 14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COOL ELECTRIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING SOLELY FROM USE OF OR INABILITY TO USE THE WEBSITE. THIS LIMITATION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED AND DOES NOT MODIFY LIABILITY OR REMEDIES ESTABLISHED IN A SEPARATE SIGNED CONTRACT FOR ACTUAL CONTRACTING SERVICES.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold Cool Electric harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the Website, your violation of these Terms, or content you submit in violation of another person's rights. This provision does not require indemnification where prohibited by law.
16. Automatic Renewals and Recurring Services
Cool Electric does not intend these Website Terms, by themselves, to enroll a consumer in an automatically renewing or continuous paid service. If Cool Electric later offers a consumer subscription, maintenance plan, or other automatically renewing or continuous service, the applicable offer and enrollment process must provide the disclosures, affirmative consent, cancellation method, reminders, and other protections required by California law.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any mandatory consumer rights or venue rules that apply, disputes relating solely to Website use will be brought in a court of competent jurisdiction in California. Nothing in these Terms requires a consumer to waive a right or remedy that cannot lawfully be waived.
18. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on the Website with an updated effective date. Changes apply prospectively from the effective date unless applicable law requires otherwise. Your
continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
19. Severability and Entire Website Terms
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, together with policies expressly incorporated into them, constitute the agreement
concerning use of the Website, but do not replace a separate signed agreement governing contracting services.
